TERMS AND CONDITIONS

Article 1 – Purpose

These regulations govern the terms and conditions of use of the upcycling service offered by Menabòh S.r.l. through the official website (www.menaboh.com). The service allows users to repair, modify, and transform pre-existing garments through tailoring work carried out by professional designers selected by Menabòh.

Article 2 – Service Operation and Communications

The upcycling process on Menabòh follows a defined workflow. Any deviation from these timelines will be promptly communicated by Menabòh at the beginning of each step of the process.

1. Request Submission 

User Flow:

  • The User browses the designers' profiles, accesses the price ranges for various services, clicks the "Start Your Upcycling" button, and is directed to a form on the website.
  • The User fills out the form on the website, uploads images of the garment, and describes the requested work, whether repairs, modifications, or transformations. If the User is unsure about the desired changes, they may leave a note about their style.
  • The User accepts the Terms and Conditions and provides the necessary data for service registration (Name, Surname, Email, Phone Number).

2. Creative Proposal 

User Flow:

  • Within 3 business days, Menabòh sends the customer a link to the proposal via email, including a sketch and a detailed description of the modifications.
  • The User can accept the proposal or request changes.

If the User requests changes, Menabòh coordinates with the Designer and sends a revised proposal within 2 business days.

3. Confirmation and Payment 

User Flow:

  • After approving the proposal, the User proceeds with the payment.
  • The User receives a shipping label to send the garment to the Designer.

4. Shipping the Garment to the Designer

User Flow:

  • The User drops off the package at an InPost pickup point.
  • The Designer receives the garment within approximately 2-3 business days.

 

5. Processing and Upcycling 

User Flow:

  • The Designer has up to 7 business days to complete the transformation unless otherwise stated.
  • Some designers may have longer default processing times. In such cases, Menabòh promptly informs the User.
  • In case of delays, Menabòh promptly contacts the customer.

 

6. Shipping the Garment to the User 

User Flow:

  • The Designer ships the transformed garment to the User.
  • Delivery takes approximately 2-3 business days.
  • The User receives an email from InPost with package pickup details, which includes a 3-5 business day window for collection.

7. Garment Reception and Feedback 

User Flow:

  • The User receives the garment and provides feedback.

Article 3 – Quality Guarantee

Quality Issues:

  • If a garment has visible defects post-upcycling (e.g., defective stitching, unfinished details), Menabòh commits to correcting the defect at no additional cost.
  • If the service was performed as described in the proposal but the customer is unsatisfied with the result, they may request modifications for an additional fee.

Repair Warranty:

  • Menabòh offers a 6 month warranty on repairs (depending on the type of repair). If a repair fails within this period, the service will be redone at no additional cost.

Article 4 – Damaged Garments

Damage While in Menabòh's Possession:

  • If a garment is damaged while in the possession of Menabòh or the Designer, we will make every effort to repair it invisibly.
  • If the damage is irreparable, Menabòh will provide compensation based on the garment's current value (proof of purchase required).

Stains on Garments:

  • If a garment is stained during the process, Menabòh will cover the cost of professional cleaning.
  • If the designer receives a stained, dirty garment, Menabòh will not cover the cost of professional cleaning. Menabòh will ensure that the customer is promptly informed of the initial condition of the garment. 
  • If the stain cannot be removed, compensation will be offered based on the garment's value at the time of booking.

Proof of Purchase:

  • To process a refund, the user must provide proof of purchase showing the garment's original value.

Article 5 – Lost Garments

Shipments Managed by Menabòh:

  • Menabòh is fully responsible for any loss of garments during shipping arranged by our service. In case of loss, compensation equal to the garment's value will be provided.

Loss by Third-Party Carrier:

  • If a garment is lost by an external courier (e.g., InPost), the user must notify Menabòh within 7 days of the expected delivery date.
  • An investigation with the courier will be initiated, which may take up to 8 weeks. If the garment is not recovered, Menabòh will offer compensation based on its value and condition.



Customer Responsibility for "Safe Place" Deliveries:

  • If the customer authorizes delivery to a safe location (e.g., mailbox, concierge), Menabòh is not responsible for any loss.

Article 6 – Fit and Alteration Policies

  • If the customer provides their own measurements and the alteration does not fit, they can request a modification for an additional fee.
  • If the Designer does not follow the provided measurements, the service will be redone at no cost.
  • If the customer clips the garment for alteration and the modification is made as requested, further adjustments will be available for an additional fee.
  • If the customer provides a reference garment for fit, they must ensure it has the same fabric and structure as the one being altered.
  • If the alteration does not match the reference garment correctly, Menabòh will redo the work at no cost.
  • If the alteration is performed as requested with respect to the reference garment, any further modifications will be subject to an additional charge.

Article 7 – Delivery Times and Refunds for Delays

  • Menabòh commits to completing upcycling within 7 business days. However, certain factors may affect timelines:
    • Complex Orders: For special modifications, an estimated completion date will be provided.
    • High Season Periods: During peak times, processing may take longer.
    • Designer Delays: If the designer takes longer than expected, Menabòh may propose a different designer to meet the customer's needs.
    • Technical Issues: In case of technical problems, the customer will be informed promptly.
    • Order Cancellation Due to Delays: If delays are significant, the customer has the right to cancel the order.
  • Compensation for Delays
    • If a delay extends without prior notice, a €30 refund will be offered.
    • Menabòh is not responsible for delays caused by force majeure (e.g., strikes, natural disasters).

Article 8 – Delivery and Return Policy

    • Failed Deliveries
      • If the package cannot be picked up within 3-5 days, the customer must contact Menabòh or the pickup point to arrange a new date. Otherwise, the package will be returned to the sender, and an additional shipping fee will be required:
        • Italy: €5-10
        • International: €10-35
    • Post-Delivery Modifications
      • If the User is unsatisfied, modifications can be requested within 7 days of receiving the garment.
  • Return Impossibility
    By proceeding with payment, the Customer acknowledges and accepts that, upon order confirmation, the garment undergoes an upcycling process that results in a personalized and irreversible transformation. In accordance with Article 59, paragraph 1, letter (c) of the Italian Consumer Code (Legislative Decree No. 206/2005), the right of withdrawal does not apply to contracts for the supply of goods made to measure or clearly personalized.
    Thus, the Customer acknowledges and accepts that, once the transformation process has begun, it will not be possible to cancel the order or request a return of the product.

 

Article 8.1 – Delivery and Return Policies for Events

  • If the User accesses the service during an event, they can leave the garment directly to the designer.

  • In this case, the User receives a proposal within 2 days, which must be approved by proceeding with payment.

  • If the User decides not to approve the proposal, they can retrieve the garment at the next event or pay for shipping for its return.

  • If the User does not proceed with payment, Menabòh will retain the garment for 30 days, after which its availability is not guaranteed.

Article 9 – Liability Release Clause

  • The User releases Menabòh from any liability for:

    • Damages caused by improper use of the service.

    • Errors due to incorrect descriptions provided by the User.

    • Aesthetic disputes, except for evident defects.



Article 10 – Data Protection

  • User data is processed in compliance with EU Regulation 2016/679 (GDPR) and will not be shared with third parties without consent.

Article 11 – Regulation Amendments

  • Menabòh reserves the right to modify the regulations, with prior notification to Users via email or website.

Article 12 – Governing Law and Jurisdiction

These regulations are governed by Italian law. Any disputes shall be subject to the jurisdiction of the Court of Arezzo.
